General conditions of sale and site use

  1. GENERAL INFORMATION

    Except in cases of explicit written notification to the contrary, our general conditions apply to all our sales contracts and all our service and delivery obligations as set down on the SA CREASET website, "www.mywebstickers.com".

    By placing an order, the buyer agrees to these conditions, notwithstanding conditions previously available on the site and possible buying conditions for the buyer.

    The present conditions also apply to the navigation and use of the website "www.mywebstickers.com".

  2. DEFINITIONS AND CONTACT DETAILS

    "The seller": Belgian Law company SA CREASET, with registered office at 9 avenue de l'industrie, 1420 Braine-l'Alleud (Belgium), listed under trade register number 084.918 (VAT BE 429.942.206), and offering its services through its website "www.mywebstickers.com". The seller can be contacted at the e-mail address "info@mywebstickers.com".

    "The non-professional buyer": any person or organisation that acquires or uses products ordered from the seller for purposes not of a professional nature.

    "The professional buyer": any person or organisation that uses, whether completely or partially, the products ordered for professional purposes. This type of buyer cannot benefit from the same protection that is accorded to those persons referred to in the previous paragraph.

    "The visitor": any person who navigates the website "www.mywebstickers.com".

  3. CREATION OF THE CONTRACT

    The products and services offered on the website "www.mywebstickers.com" do not in any way constitute a contractual offer whereby the buyer, professional or otherwise, can bring about a contract solely by expressing a desire to do so.

    However, the information provided by the buyer when it is accessing the website "www.mywebstickers.com" constitutes an offer to buy, which is subject to the application framework of the present general conditions.

    The seller reserves the right to check, by methods of its choice, the identity of the order and judge whether it is genuine. The seller may reject an order from a client with whom litigation has been entered into or for which there are doubts that the order is genuine. Furthermore, for an order to be accepted, the total sum must exceed €12.

    The contract is created when the seller conveys by e-mail its acceptance of the order. This notification must be given in the 48 hours following the order from the buyer: if this condition is not met, the order is to be considered as rejected. The seller can, however, make contract validity subject to different conditions; in the case, for example, of large-scale orders, orders placed by minors, incomplete or incorrectly completed order forms, or non-payment of previous deliveries.

  4. PRICES

    All orders are processed according to the prices in use at the time the order was placed.

    The cost of the products is payable either in advance through the secure payment site "Ogone" on validation of the order, or by bank transfer to account number 551-4027700-38 of the seller within eight working days following the order, or upon pickup from a "Kiala" point if the buyer chose this option when placing the order.

    All orders exceeding the sum of €500 excluding VAT must be paid through the secure payment site "Ogone" or by bank transfer within eight working days following validation of the order.

    If the buyer pays by bank transfer, the order will only be processed after the seller's account has been credited with the required sum. If the account is not credited in the above-stipulated period, the contract is considered never to have existed.

    In the event of non-payment within eight working days following the order, the buyer will be subject to a standard indemnity payment equal to 15% of the due sum, with a minimum surcharge of €15 and a standard interest on arrears of 12% per year.

    Delivery costs are not charged for deliveries to Belgium and Luxembourg. Delivery costs for other destinations are detailed on the order page of the website.

  5. IDENTIFICATION AND PRIVACY POLICY

    From the moment the buyer decides to purchase products on offer through the website "www.mywebstickers.com", it is obliged to identify itself in accordance with the practices detailed on the website "www.mywebstickers.com". This information is indispensable for the conclusion of the contract.

    All personal data regarding the buyer is intended for internal use by the seller. The seller will use this personal information to carry out the processing of orders. This information may be used by the seller for statistics so as to improve the site or distribute, by whatever means of communication, information relative to its commercial activities. The seller undertakes not to divulge this information to third parties.

    Buyers have the right to access and rectify their personal data. To this end, they can contact the seller directly by e-mail or through the post to the address detailed in point 2.

  6. VAT AND CUSTOMS

    The prices posted on the website "www.mywebstickers.com" are VAT inclusive. Any increase in VAT rates is at the expense of the customer. The VAT regulations are those established by EC edict, more particularly for distance selling,

    For customers from outside of the EC, the prices posted on the website "www.mywebstickers.com" do not include the various customs duties. These are always at the expense of the customer, who alone is to carry out all the necessary formalities to place their purchases in free circulation in their country of origin.

  7. DELIVERY

    The delivery of packages can only be carried out for the following countries:
    • Belgium
    • Luxembourg
    • The Netherlands
    • [France]
    The seller and its service "My Web Stickers" undertakes to do all it can to ensure that ordered products are delivered within the delivery periods posted on the website. Delivery periods are however intended only for information purposes and the seller will not be held responsible for any possible delays. The average delivery period for available items is eight working days from notification of the acceptance of the order.

    In the event of an error in the provision of details, the seller will not be held responsible for losses or any damage whatsoever. The buyer must carefully check the state of the package and communicate any possible reservations to the pick-up point or by e-mail to the seller, in the event of missing elements or damage.

    Products are delivered to a "Kiala" point of the buyer's choice.

  8. CLAIMS

    Any claims as to non-conformity or missing elements for deliveries must be sent by e-mail within the 48 hours following receipt of the order. In doing this, the buyer must contact the seller, by e-mail or through the post, to receive a return reference that must unconditionally feature on the original external packaging of the complete returned order. The buyer may not return the merchandise without prior authorisation by the seller. Returns are only possible for products that have not suffered any modification or alteration on the part of the buyer.

  9. RENUNCIATION

    For orders involving products made according to buyer specifications, or that are highly personalised, or by their nature cannot be returned, or are susceptible to deterioration, the non-professional buyer does not have the right of renunciation provided by the consumer protection law of 14 July 1991. Given that all orders placed through the website "www.mywebstickers.com" are processed according to the specific requests of buyers, the right of renunciation can never be applicable in the case of non-professional buyers.

  10. BUYER'S RESPONSIBILITIES

    The buyer, professional or otherwise, is entirely responsible for the choice, use and application that it will make of the delivered products. In this respect, the seller may never be held responsible for any material damage or other inconvenience caused by the buyer.

  11. FORCE MAJEURE

    Ordersare processed as quickly as possible, taking into account the seller stock levels and capacities for processing and production. If, as a result of unforeseen circumstances beyond the seller's control, it is unable to honour its obligations, it has the option of suspending its obligations for as long as said circumstances persist or of cancelling the agreement simply by means of written notification to the buyer.

    No compensation of any kind may be demanded from the seller in cases of force majeure.

    Strikes and bad weather are always to be considered as cases of force majeure.

  12. LIMITATION OF SELLER'S RESPONSIBILITY

    For all the stages of site access, order process, delivery, and after-sales service, the seller only has an obligation of due care.

    Any inconvenience or damage resulting from use of the Internet network, and in particular connection failures, outside intrusion or presence of computer viruses, cannot be considered as the responsibility of the seller.

    The seller cannot be held responsible for any damaging consequences foreseeable or otherwise, resulting directly or indirectly, at once or subsequently, caused by or in connection with the knowledge or use of its website "www.mywebstickers.com". The seller does not guarantee that the website "www.mywebstickers.com" will not be subject to interruptions or free of errors.

    With regard to sites to which the seller provides a link, visitors are advised that the content of said sites is constantly subject to change or deletion. The seller has no control over the content, reliability, validity, legality, security and free accessibility of said sites. The seller limits itself to informing others of the existence of a site and has no further responsibilities. Visitors consult these sites at their own risk, and should take care to respect the integrity of sites visited, starting with the home page, and to respect the viewing conditions of each site. Visitors are advised that the seller is in no way the owner of the sites concerned, and that any association between the seller and these sites is to be avoided.

  13. INTELLECTUAL PROPERTY RIGHTS

    Any brands, company names, logos and acronyms that may appear on our web pages belong exclusively to their owners. The seller advises the visitor that it is oblivious to the influence of the brands that may appear, and that this influence can only be to the advantage of the brand owners in question.

    All the intellectual property rights applicable to the elements of the website "www.mywebstickers.com" are the exclusive property of the seller, without any exception whatsoever.

    The information available on the website "www.mywebstickers.com", its graphic design, the hypertext design in the page layout, the corporate name, domain name and logo are elements that are protected by law and in particular the law on the protection of databases, laws on copyright ownership, and international agreements in this area as well as regulations on the subject of domain names. These elements cannot be reproduced in any form, format or manner whatsoever, nor may they be used or distributed without the prior written consent of the seller.

  14. COMPETENT COURTS

    In the event of litigation, the courts of the judicial district of Nivelles shall alone be competent. The present general conditions of sale and use are subject to Belgian law. Belgian commercial law is applicable in the case of professional buyers.
